Douglas Conservation Commission Issues Compliance Certificate, Negative Determination, and Order of Conditions

DOUGLAS — March 2, 2026 — Douglas Conservation Commission cleared three properties and continued five others at its March 2 meeting. The board voted 4-0 to issue a certificate of compliance for Jacob Bloniarz at 125 Ledgestone Road after engineer Jude Gaubin of OHI Engineering corrected an inaccurate site plan that had shown a retaining wall in the wrong location. The commission also approved a 4-0 negative determination — with conditions requiring site stabilization and erosion controls to remain in place — for 103 Shore Road, the site of a court-ordered house demolition carried out in late January under a Middlesex Superior Court contempt order; property representative Jim Tassino told the board the septic system was never installed and the building was only a shell when litigation began roughly 15 years ago. A 4-0 order of conditions with standard special conditions was issued for a new single-family home at 48 Northwest Main Street (DEP 143-1124) after Brandon Fanaf's revised wetland delineation flags were incorporated into the plan. A stone wall enforcement case at 23 Smith Hill Way on Whitin Reservoir was continued to May 18 after Chair Mark Mungeam stated he was "not okay" with rock placement in the 25-foot no-disturb zone and called for a spring site visit before a final decision; the commission also agreed to seek Town Counsel guidance on whether the town's wetland bylaw requires a separate no-disturb setback from the 100-year floodplain boundary.
