Douglas Conservation Commission denied a certificate of compliance for a completed project at 100 Pine Street after discovering unpermitted stone gate pillars, a widened driveway and disturbed soil inside Bating Brook's 200-foot riverfront buffer. The board voted 5-0 to issue an enforcement order requiring the property's new owner to stop work and file a notice of intent, and voted 5-0 to send former owner Russ Amato a letter stating his application would have qualified for compliance had the new work not occurred. Amato told the commission, "Whatever I did here is on me," describing the new owner's own admission.
In a separate matter, the board split 4-1, with member Brendan Doyle dissenting, on tree-removal determinations for a Southeast Main Street property, issuing a negative determination for three hazardous trees while requiring a full notice of intent for other clearing. The board also continued subdivision reviews on White Court and Southeast Main Street to resolve wetland-boundary and stormwater questions, and heard a resident complaint about unauthorized brook-side clearing on Perry Street.
